Garfield New Jersey Theft Defense Lawyers
All theft crimes in New Jersey, whether it be theft by deception, receiving stolen property, shoplifting or theft of moveable property are graded by the dollar amount of the item(s) in question. For example, if the dollar amount of the items in question was less than $200, the Defendant would be charged with a disorderly persons offense (misdemeanor). However, if the dollar amount was greater than $200 but less than $500, the Defendant will be charged with a fourth degree felony and if the dollar amount was more than $500 but less than $75,000 the Defendant will be charged with a third degree felony. An off duty Garfield Sergeant was in the right place at the right time yesterday. He was able to radio for help and the Defendant was pulled over a short distance down the road.
The driver and the passenger, one from Bloomfield and the other from Paterson, New Jersey were arrested and charged with theft of moveable property, possession of marijuana under 50 grams and possession of a weapon, a collapsible baton. Both are currently being held in the Bergen County Jail on a $10,000 bail. Since the snow blowers were most likely valued at more than $500, the Defendants will be charged with theft of moveable property in the third degree.
