A thirty-two year old male from Bergenfield, New Jersey was arrested yesterday afternoon following what detectives are calling a failed robbery. Apparently the Defendant approached a gas station attendant in New Milford and demanded he turn over all the money in the register. When the attendant refused and retreated into the booth, the Defendant fled the scene in his vehicle. Following a brief investigation the Defendant was apprehended without incident and taken to the Bergen County Jail where he remains being held. Since the Defendant did not use nor did he threaten to use a weapon he was charged with attempted robbery in the second degree. Based on the new bail guidelines which began in January of this year, the Defendant will have to wait 48 hours to determine whether he will be released or held without bail until trial.
Robbery in the second degree is a rather serious offense. If convicted, the Defendant will face up to ten (10) years in a New Jersey State Prison and a fine up to $150,000. In addition, robbery falls under the No Early Release Act (NERA) which in essence requires a Defendant to serve at least 85% of their sentence before they can become eligible for parole.
