Hackensack Robbery Charge Attorney
A robbery charge is codified under New Jersey law as 2C:15-1. Typically robbery is charged as a second degree felony (indictable). This means hat a defendant, if convicted, can face up to ten years in a New Jersey state prison, up to a $150,000.00 fine, and faces a presumption of incarceration. A presumption of incarceration means that if convicted, it is presumed that the defendant will be sentenced to time in prison. A robbery can be charged as a first degree crime if, “if in the course of committing the theft the actor attempts to kill anyone, or purposely inflicts or attempts to inflict serious bodily injury, or is armed with, or uses or threatens the immediate use of a deadly weapon”. A first degree crime carries up to twenty years in state prison, up to a $200,000.00 fine, and also carries a presumption of incarceration.
