The reports indicate that, in all, the police seized over 2.2 pounds of marijuana and $13,900 in cash. Apparently, while one of the officers was speaking to the homeowner who filed the initial complaint, his partner, who was standing nearby saw through a basement window two individuals packaging marijuana.
Both defendants were charged with a possession of marijuana with the intent to distribute, possession of marijuana with the intent to distribute within 1,000 feet of a school and the unlawful possession of drug paraphernalia. Both defendants remain in the Bergen County Jail with bails set at $35,000 and $15,000.The defendants are facing two third degree felonies. A crime of the third degree is punishable by up to five years in a New Jersey State Prison, fined up to $35,000 and a potential six month loss of their driving privileges. In addition, since this offense is alleged to have happened within 1,000 feet of a school, the defendants offense is subject to Brimage. These are mandatory guidelines, instituted by the Legislature, in an effort to create uniformity in the prison sentences imposed for defendants convicted of drug distribution charges in the New Jersey. Pursuant to the Brimage guidelines, they not only require mandatory prison sentences but mandatory parole ineligibility terms as well.
