What the State must prove:

The New Jersey Legislatures have taken an even more extreme stance on repeat offenders. Now pursuant to N.J.S.A. 2C:40-26, an individual who is determined to be a repeat offender for Driving While Suspended for a prior DWI will be charged with a fourth degree felony. {It is important to note that Driving While Suspended is ordinarily a Traffic Offense and NOT a Criminal Offense} If a person is convicted of this charge they will be sentenced to a minimum of 180 days in a New Jersey State Prison and the defendant will not be eligible for parole.
