As you can tell from above, a perjury charge, codified as 2C:28-1, is a serious charge. In order for the Bergen County Prosecutor’s Office to prove this charge beyond a reasonable doubt, they will have to prove:

  • if in an official proceeding the defendant makes a false statement under oath or equivalent affirmation, or
  • swears or affirms the truth of a statement previously made, and
  • the statement is material and the defendant does not believe it to be true.

Under the statute, material means if the statement could have affected the course or outcome of the proceeding or the disposition of the matter. It is not a defense that the defendant mistakenly believed the falsification was immaterial. Materiality is a question of the law, which means it is something a judge would decide. What are the penalties for a perjury charge? Perjury is a third (3rd) degree felony (indictable). This means that if a defendant pleads guilty or is convicted after trial, then they can face anywhere between five (5) to three (3) years in a New Jersey state prison. Lastly, a fine of up to $15,000.00 can be imposed by a Bergen County Judge.
