If you are convicted in New Jersey of a second violation of Driving While Intoxicated and your first offense was within ten (10) years, you will be subject to the following:

  • A defendant will be subjected to a mandatory Bergen County Jail sentence, which can range from two-ninety days. However, at the discretion of the Judge, the defendant may be ordered  to serve the jail sentence in an in-patient rehabilitation program or in the Intensive Drivers Resource Center.
