Under the new DUI law, the penalties have been lessened. However, this does not mean that the penalties can still have an impact on a defendant’s life. Blowing a .15 or higher
If a defendant blows a .15 or higher on a breathalyzer, they face the following penalties:
- 4-6 months loss of license
- After restoring your license, 9-15 months of an interlock installed in your vehicle
- up to 30 days in Bergen County Jail
- 12-48 hours at the IDRC
- fines and fees of over $500
Blowing a .10 but less than a .15
If a defendant blows a .10 but less than a .15, they face the following penalties:
- loss of license until the interlock is installed in your vehicle
- 7-12 months of an interlock installed in your vehicle
- up to 30 days in the Bergen County Jail
- 12-48 hours at the IDRC

Blowing a .08 but less than a .10
If a defendant blows a .08 but less than a .10, they face the following penalties:
