Another Heroin Bust in Mahwah NJ
A routine motor vehicle stop in Mahwah New Jersey leads to the arrest of a mother and her son. According to the arresting officers, a search of the defendants vehicle revealed a brick of heroin, several Xanax pills and syringes. The initial reports indicate that after the arresting officers stopped the defendants white Ford Fusion for a routine traffic stop. Then upon speaking with the driver the officer determined that both the driver and the passenger were showing signs that are consistent with drug use. Based on the officer’s initial observations and his status of being a certified drug recognition expert, he asked permission from the driver for consent to search the vehicle for contraband. Consent was granted and the search revealed the heroin, Xanax and syringes.
Both the defendant and his mother have been charged with two counts of possession of heroin and one count of possession of heroin with the intent to distribute (for more information on heroin distribution click here). The son was also charged with one count of possession of Xanax and his mother was also charged with possession of drug paraphernalia (syringes). According to the reports both defendants were released on their own recognize. There matters will be sent to the Bergen County Prosecutor’s Office for review.
The heroin possession, heroin distribution and possession of prescription drugs (Xanax) are third degree felonies in New Jersey. A third degree felony is punishable by up to five years in a New Jersey State Prison and up to a $35,000 fine for the heroin and up to a $200,000 for the prescription drugs. In addition to the fine and the potential jail time, both defendants also face up to a two year loss of their driving privileges.
