Fort Lee DWI/DUI

December 1, 2019 changed New Jersey DWI/DUI penalties. Prior to the change, a first offense DWI had up to ten months of your driving privileges suspended. At a minimum (depending on the facts of the case and a skilled criminal defense attorney) an individual faced with a first offense DUI could get three months loss of license.  Under the old DWI laws, a person with a second DWI faced two years loss of license, and a third DWI had ten years loss of license.

New NJ DWI Laws

Under the new DWI laws here in New Jersey, an individual faced with a first offense can potentially lose his license only for a couple hours.

  • First Offense DWI
    • .08 but less than .10
      • Loss of license is only until an interlock device is installed
      • Interlock is only required for 3 months
    • .10 but less than .15
      • Loss of license is only until an interlock device is installed
    • Higher than a .15
      • Loss of license is up to 6 months, but at a minimum of 4 months loss of license.
  • Second Offense DWI
    • one to two years loss of license
  • Third offense DWI
    • eight years loss of license

Even though the new DWI laws here in NJ have been relaxed to a certain extent, a DWI can still have a lasting impact on your finances. If convicted of a first offense DWI but blew less than .10, you can face up to a $400 fine, a $125 surcharge, $100 DDEF surcharge, and up to $158 in other fines and court costs. Not to mention, 12 to 48 hours at the Intoxicated Drivers Resource Center. Blowing above a .10 and being convicted of a first DWI carries with it more fines and more penalties. A second and third DWI in New Jersey can coast an individual well over a thousand dollars in fines, surcharges, and court costs.
