Elmwood Park, New Jersey Eluding Attorneys
In New Jersey, the offense of eluding can be either a second or third degree felony depending on the the underline facts surrounding the charges. The difference between a second degree eluding and a third degree eluding will boil down to whether the prosecution can prove beyond a reasonable doubt that the Defendant’s conduct “created a risk of death or injury to another person”. To make matters worse, the prosecution is afforded the presumption that the Defendant’s conduct did in fact create a risk of death or injury to another if any Title 39 (traffic offense) was committed.
