A man from North Bergen, is on trial because he is accused of raping an eight-year-old girl. It is alleged that the Defendant made video recordings of his sexual assault on this young child. The Defendant appeared in court to discuss whether or not the videos that he allegedly created should be allowed to be used as evidence against him in court.

The Defendant, a 40-year-old male, is facing charges that include sexual assault, multiple counts of endangering the welfare of a child, child abuse, and the possession and distribution of child pornography. He is also accused of showing the video that he allegedly made of himself raping the eight-year-old girl to another female. On seeing this she reported the situation to local authorities. This took place back in November of 2011. Then on December 2, after investigation by the special victims unit in Hudson County, the Defendant was arrested.

The investigation uncovered 14 videos containing child photography. However, the video where it is alleged that he raped the eight-year-old girl was never found. This is according to Deborah Simon Deputy First Assistant Prosecutor. The Defendant’s attorney, is arguing that if these videos were allowed in court they would taint the jury’s view of his client. Judge Lisa Rose, of the Hudson Superior Court has not yet ruled on the matter. A follow-up hearing is scheduled for February 26, 2013.
