Suspect arrested & charged in Elmwood Park NJ with Robbery, Burglary & Criminal Restraint

A Paterson man was arrested by the Elmwood Park Police Department and charged with robbery. It is alleged that the defendant, a twenty-five year old resident of Paterson New Jersey, forced the hotel manage of the Townhouse Inn into a back room before removing $150 from the register. In addition, the initial reports indicate that the Defendant prior to forcing the manager into the back-room had her order him a cab, which he later used in his attempt to evade the police. According to the Elmwood Park Police Department, the cab service which the defendant fled in, was key to them locating and subsequently arresting the defendant.

The Defendant is currently being held in the Bergen County Jail on a $20,000 bail. Records indicate that the Defendant along with being charged with robbery, is also being charged with burglary and criminal restraint, as well. The Defendant will be charged with robbery in the second degree and if convicted he could serve up to ten years in a New Jersey State Prison. In addition, he must serve 85% of his sentence before he could become eligible for parole pursuant to the No Early Release Act. To be convicted of robbery (N.J.S.A. 2C:15-1) in New Jersey, the State must prove beyond a reasonable doubt that:

 

A person is guilty of robbery if, in the course of committing a theft, he:

(1) Inflicts bodily injury or uses force upon another; or

(2) Threatens another with or purposely puts him in fear of immediate bodily injury; or

(3) Commits or threatens immediately to commit any crime of the first or second degree.

An act shall be deemed to be included in the phrase “in the course of committing a theft” if it occurs in an attempt to commit theft or in immediate flight after the attempt or commission.
