NJ Firearms: 18 U.S.C. 921-931 Lawyer
A firearm is defined under federal law as a weapon which an expel a projectile either by explosive or designed/converted to readily do so. Antique firearms, however, are not included. Under 18 U.S.C. 922, federal law prohibits a certain person from possessing a firearm. Under this law, the prosecutor must prove beyond a reasonable doubt that:
- the defendant was in possession or in receipt of a firearm or ammunition;
- the firearm or ammunition was transported across state lines; and
- the defendant is:
- a convicted felon, or
- a fugitive from justice, or
- a drug user, or
- an alien (this includes illegal aliens) lawfully admitted under non-immigrant visas, or
- a defendant subject to a domestic violence restraining order, or
- a defendant convicted of a misdemeanor domestic violence charge, or
- a citizen that has renounced their US citizenship, or
- a veteran that was dishonorably discharged from the US military
Possible Penalties
A conviction is punishable by up to ten (10) years. A more severe sentence of a minimum of fifteen years in prison can be imposed if the defendant has three or more prior felony convictions that is either violent or drug related. A fine of up to $250,000.00 can be imposed as well.
