An Alabama man is facing gun charges over a traffic stop in Franklin Lakes on January 26. Terry Bagwell, from Cullman Alabama, was pulled over when apparently the Franklin Lakes police officer located the guns. The Franklin Lakes police officer located hunting rifles and a .22-caliber handgun which allegedly were not properly stored inside Bagwell’s car. It is not known why Bagwell was pulled over. Moreover, Bagwell has a previous offense, which is also unknown. This means besides the gun charges he is facing, he will also be facing a certain person to not possess a firearm charge. He supposedly has a first appearance on Thursday, January 28 at Central Judicial Processing Court in Hackensack.

The charges Bagwell faces are very serious. The most serious charge he faces is N.J.S.A. 2C:39:5B(1), Unlawful Possession of a Handgun Without a Permit. This charge is a second (2nd) degree crime. That means if convicted or if he pleads guilty, he can face up to ten years in a New Jersey state prison. In addition to this, the unlawful possession of a handgun falls under the Graves Act. The Graves Act requires that at a minimum the defendant serve five years in New Jersey state prison, and is ineligible for parole for over two years.
The next most serious offense is N.J.S.A. 2C:39-5C(1), Unlawful Possession of Weapons-Rifles/Shotguns. This is a third (3rd) degree charge, which carries up to five years in New Jersey state prison. It also carries a up to a $15,000.00 fine.
