The offense of eluding can be either a second or third degree felony in New Jersey. What elevates a third degree eluding to a second degree is if the prosecution can prove beyond a reasonable doubt that the Defendant’s “flight or attempt to elude created a risk of death or injury to another person”. Englewood Police Chase ends in Crash in Paramus, NJ

According to the reports, the Englewood police department began chasing a defendant who they allege was committing a theft of copper pipping from abandoned residents within the city. The police were tipped off about the alleged theft when a neighbor reported suspicious activity to the police. The police were able to conduct a motor vehicle stop on the car that they believed was involved in the theft, however, once the car pulled over, it quickly took back off. At this point, it has been reported that a co-defendant, bailed out of the defendant’s vehicle, stating that he didn’t want to be involved in the eluding. The defendant was then noticed by a Fort Lee police officer filling up his vehicle at a Paramus gas station along Route 4. The officer notified the Paramus Police Department, who was able to quickly close on the defendant’s vehicle. Somehow, the defendant’s vehicle collided with a Paramus police officer’s and at this point the defendant took off on foot. He was eventually apprehended.

The Defendant has been charged with two counts of aggravated assault on a police officer, burglary in the third degree, criminal mischief, obstruction, eluding in the second degree and theft of moveable property. The co-defendant who, bailed out of the car prior to the eluding, will most likely be charged with burglary in the third degree, theft, criminal mischief and obstruction of justice.
