Applicable Penalties:

The New Jersey Legislatures have taken a stern approach on the penalties associated with anyone convicted of Driving While Suspended. An individual convicted of Driving While Suspended could face a substantial fine, a license loss and a possibility of being incarcerated.  These are extremely harsh penalties, especially for someone who might be completely unaware of the fact that their license was suspended. In New Jersey, one’s license may be suspended as a result of a failure to comply with a court-imposed time payment order from a prior traffic violation.

Exceptions to the otherwise harsh penalties:

Fortunately the Legislatures have carved out certain exceptions for those who are charged with Driving While Suspended when the suspension is related to a missed court ordered time payment.  If an individual can prove to the Court that they have since rectified their court ordered time payment, a prosecutor may amend the underline Driving While Suspended, a violation of N.J.S.A. 39:3-40 to a Driving While Suspended, in violation of N.J.S.A. 39:3-40(i). This amendment will make a drastic difference when it comes time to imposing a sentence; the applicable penalties for a violation of N.J.S.A. 39:3-40(i) consist of a fine usually totaling $100.00 and no license loss.
