Pursuant to N.J.S.A. 39:3-40, “no person to whom a driver’s license has been refused or whose driver’s license or reciprocity privilege has been suspended or revoked, or who has been prohibited from obtaining a driver’s license, shall personally operate a motor vehicle during the period of refusal, suspension, revocation, or prohibition.”

Applicable Penalties:

A first time offender convicted of Driving While Suspended could face up to a $500.00 fine and a license loss of up to six months.  However, the Legislature has carved out certain exceptions to the otherwise harsh penalties associated with Driving While Suspended in New Jersey.  Pursuant to N.J.S.A.39:3-40(i), if an individual charged with Driving While Suspended as a result of unpaid parking ticket(s) can present adequate proof that underline parking ticket(s) has been satisfied, the Court may diverge from the otherwise harsh penalties.  The Court may impose a much more modest fine, normally $100.00 and has the discretion to refrain from suspending one’s driving privileges.
