  • If a Defendant is caught possessing less than 1/2 ounce of methamphetamine in New Jersey they will be charged with a third degree felony. A third degree felony in New Jersey is punishable by up to five (5) years in a New Jersey State Prison, a fine not to exceed $35,000 and a mandatory six (6) month to a two (2) year loss of driver’s license.

In addition, pursuant to Brimage, the Defendant will almost certainly be sentenced to a parole ineligibility term as well.
  • If a Defendant is caught with more than 5 ounces of methamphetamine in New Jersey they will be charged with possessing the crystal meth with the intent to distribute in the first degree. If convicted, the Defendant will be facing up too twenty (20) years in a New Jersey State Prison, fined up too $200,000 and a mandatory six (6) month to a two (2) year loss of driver’s license. In addition, pursuant to Brimage, the Defendant will almost certainly be sentenced to a parole ineligibility term as well.
