Keith G. Oliver from our office just finished up representing a client that was charged with and indicted on various weapons and drug offenses in Bloomfield, New Jersey. Specifically, the Defendant was charged with possession of cocaine in the third degree, possession of cocaine with the intent to distribute in the second degree, possession of cocaine with the intent to distribute within 1000 feet of a school in the third degree, possession of cocaine with the intent to distribute within 500 feet of a public park in the second degree, unlawful possession of a weapon in the second degree and unlawful possession of a weapon during the commission of CDS offense in the second degree. The charges stemmed from a motor vehicle stop which occurred just before midnight on February 19, 2016. Subsequent to the motor vehicle stop a search of the vehicle took place. Located inside the vehicle was a BB Gun, more than 1/2 ounce of cocaine, less than 1/2 ounce of heroin, less than 50 grams of marijuana, hypodermic syringes, scales and a ski mask. The Defendant and his three passengers were arrested and all charged with various offenses depending on their admission made at the scene. A through review of the discovery by Mr. Oliver revealed several rather significant proof issues for the State with regards to the drugs that were located inside the vehicle. Based on that information Mr. Oliver was able to negotiate a resolution for the Defendant that not only included no incarceration but the potential for no criminal record as well. The Defendant, based on the compelling reasons submitted on his behalf by Mr. Oliver was able to enter the Pretrial Intervention Program (PTI). If the Defendant successfully completes the program he will be able to walk away from these other life changing charges without a criminal record. Furthermore, if the Defendant is able to successfully complete the PTI program he will be able to expunge from his record the underline arrest as well. That in essence will completely erase this event from his life. If the Defendant was to be convicted of these offenses, he would be facing a potential five to ten year State Prison sentence on each second degree charge, not to mention another three to five years on each third degree offense.
