Cocaine Distribution Charges issued in Hasbrouck Heights NJ
The Hasbrouck Heights Police Department has arrested and charged a Paterson New Jersey resident with distributing cocaine within 1000 feet of school, distributing cocaine with in 500 feet of a park, possession of cocaine and possession of marijuana. It appears from the initial reports that the Hasbrouck Police Department became aware of the defendant after they were able to conducted a series of undercover buys from him. During those buys, it is alleged that the defendant sold their undercover agent various quantities of cocaine. When the detectives arrested the defendant they were able to seize more than an ounce of cocaine and undisclosed quantity of marijuana. Due to the quantity of drugs seized, the defendant will be charged with three second degree felonies. A second degree felony in New Jersey is punishable by up to ten (10) years in state prison. In addition, since this incident is a believed to have occurred within 500 feet of a park and within 1000 feet of a school, the defendant will also be subject to Brimage. Brimage was created in an effort to create uniformity in sentences imposed for various drug distribution offenses. It in essence requires that defendants convicted of certain drug distribution cases be sentenced to state prison with mandatory parole ineligibility terms.
The defendant is currently being held in the Bergen County Jail on a $150,000 bail. He will most likely be formally charged with possession of cocaine, distribution of cocaine within 1000 feet of a school, distribution of cocaine within 500 feet of a park and possession of marijuana with the intent to distribute. In addition, the detectives also seized $1,245 in cash.
