It was in 1998 when Carmine Franco agreed to no longer participate in the garbage removal business in New Jersey. This agreement came four years after he was charged with defrauding the state of New Jersey, and Bergen County of millions of dollars. He did this by sending garbage to landfills that were out-of-state. However, New York prosecutors never believe that Franco ever truly left the garbage removal business.

Franco is a 77-year-old resident of Ramsey, New Jersey, who is said to have strong connections to organized crime in the area. He will serve as the first defendant in an indictment that was recently unsealed in federal court in Manhattan. This 35 page document claims that Franco along with almost 30 other defendants used threats of violence (terroristic threats) and other economic retaliation as a way to maintain control over important parts of the garbage removal and garbage hauling industry. His alleged crimes took place in both New Jersey and in New York City.

As part of his illegal activities, Franco is alleged to have engaged in stealing of garbage containers (theft of moveable property). These containers would then be stolen from a competitors hauling company in New York City. The containers would then be modified to appear as if they were from a company that he controlled and then these would be sent across state lines to New Jersey.
